Here's a breakdown:
Assault with a weapon or causing bodily harm
267 Every person is guilty of an indictable offence and liable to imprisonment for a term of not more than 10 years or is guilty of an offence punishable on summary conviction who, in committing an assault,
- carries, uses or threatens to use a weapon or an imitation thereof,
- causes bodily harm to the complainant, or
- chokes, suffocates or strangles the complainant.
Key Elements of Assault with a Weapon
To be convicted, the Crown must prove that a person had the objective foresight to know that the assault could and did cause bodily harm to another person including wounding, maiming, or disfiguring the other person. For example, by throwing a rock at someone’s nose, and striking their nose, that they would or should have known that the person’s nose breaking was likely or possibly would occur. Further the Crown would need to show that the rock did in fact cause that the wound/injury was caused by the rock.
