At Bonn Law, we understand that the aftermath of an automobile accident can be overwhelming. That is why we are here to help you navigate the complexities of accident benefits in Ontario to ensure you receive the support and compensation you deserve.

What are Accident Benefits?

Accident benefits are a mandatory component of all automobile insurance policies in Ontario. These benefits provide crucial financial assistance to individuals who are injured or killed in a motor vehicle accident, regardless of who is at fault. The Statutory Accident Benefits Schedule (SABS) outlines the specific benefits available, which include:

Income Replacement Benefits: If you are unable to work due to your injuries, you may be eligible to receive up to 70% of your gross income, capped at $400 per week. Optional coverage can increase this amount to $1,000 per week.

Non-Earner Benefits: If you do not qualify for income replacement benefits and are unable to carry on with your normal activities, you may receive $185 per week.

Caregiver Benefits: If you are the primary caregiver for a dependent and can no longer provide care due to your injuries, you may be compensated for hiring someone to assist with caregiving.

Medical, Rehabilitation, and Attendant Care Benefits: These benefits cover the costs of medical treatments, rehabilitation services, and attendant care required as a result of your injuries.

Death and Funeral Benefits: In the unfortunate event of a fatal accident, these benefits provide financial assistance for funeral expenses and compensation to the deceased’s family. The following is to be paid out:

  • $25,000 to spouse
  • $10,000 to each of dependents
  • A maximum of $6,000 for funeral expenses
  • $10,000 to former spouses if the person had financial obligations to them

You have the options to increase limits up to $50,000 for your spouse, $20,000 to dependents, and $8,000 for funeral expenses.

  • Other Expenses: Accident benefits also cover additional costs such as housekeeping and home maintenance, lost educational expenses, and expenses for visitors during your recovery

What are Optional Accident Benefits?

You have the option to increase limits for income replacements, medical care, caregiver benefits, death and funeral benefits, and more. Below is what you can add:

  • Dependent care benefits: Cover up to $75 weekly for first dependent and $25 for each additional dependent. Only to be claimed if you were employed at the time of the accident and have to pay for additional childcare expenses.
  • Indexation: Gives you an annual adjustment for yearly inflation rates. Adjustments to be done by the Consumer Price Index of Canada.
  • Up to $130,000 in additional medical expenses
  • Additional death and funeral expenses up to $50,000, raises dependents to $20,000
  • Catastrophic impairment up to $1 million
    Extra income replacement
